1. About us

Email: hello@smouche.co.uk. We aim to reply within 24 hours, Monday to Friday (UK time).

2. These terms

These terms explain how we sell our products to you. They apply to every order you place on our website, so please read them before you order. If you have any questions, just email us.

Our products are for your own personal use. These terms are for customers in the United Kingdom.

We may update these terms from time to time. The version that applies to your order is the one shown on our website when you placed it.

3. Our product

We sell Smouche Colour-Changing Foundation. It comes out white and adapts to your skin tone as you blend it in. It’s made for fair to medium skin tones.

We make the colours in our photos as accurate as we can, but everyone’s skin is different and every screen shows colour slightly differently, so the result on your skin may look a little different.

Please read the ingredients on the product page and on the box before use. If you have sensitive skin or allergies, try a little on a small area first. If your skin reacts, stop using the product and email us.

4. Prices and payment

All prices are in pounds sterling (£) and include VAT where applicable.

Delivery is free. The total you pay is shown on the checkout page before you confirm your order.

You can pay by credit or debit card, PayPal, Apple Pay or Google Pay. Payments are processed securely by PayPal. We take payment when you place your order.

If we find an obvious mistake in a price, we’ll contact you before your order is sent. You can then choose to go ahead at the correct price, or cancel for a full refund.

5. Placing your order

Our contract with you starts when we email you to confirm your order. If we can’t accept your order (for example, because a product is out of stock), we’ll tell you and refund you in full.

Your order confirmation email is your copy of our contract. We keep a record of your order and can send you another copy if you ask. Our contracts are in English only.

6. Our offers and free gifts

7. Delivery

We deliver to the UK and abroad.

Delivery is free and tracked. You’ll find our delivery times on our Delivery & returns page.

Unless we agree a different date with you, we’ll deliver your order within 30 days of accepting it. If something outside our control delays your order, we’ll let you know as soon as possible.

Please check your delivery address and postcode carefully at checkout. If you spot a mistake, email us straight away and we’ll do our best to correct it before your parcel is sent.

Your order is your responsibility from the moment it’s delivered to you, or to someone you’ve asked to receive it. It becomes yours once we’ve received full payment.

8. Your right to change your mind

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you can cancel your order for any reason within 14 days. The 14 days start the day after you receive your order. If your order arrives in more than one parcel, they start the day after you receive the last one. You can also cancel before your order arrives.

To cancel, simply tell us clearly before the 14 days are up. You can email us at hello@smouche.co.uk, or use the model cancellation form at the end of these terms (you don’t have to use it). We’ll confirm by email that we’ve received your request.

Opened bottles: for health and hygiene reasons, this right doesn’t apply to a bottle that has been unsealed after delivery. Unopened, sealed bottles can be returned as normal. If you’ve opened a bottle and the shade isn’t right for you, our 30-day shade-match guarantee still covers you (see section 10).

9. Returning your order and getting your refund

10. Our 30-day shade-match guarantee

We want you to love your shade. So, on top of your legal rights, we offer a 30-day shade-match guarantee:

This guarantee is given by Smouche (our address is in section 1). You also have legal rights in relation to products that are faulty or not as described. This guarantee does not affect those statutory rights.

11. If something is wrong with your order

We’re required by law to provide products that are as described, fit for purpose and of satisfactory quality. Nothing in these terms affects your legal rights under the Consumer Rights Act 2015. In short:

If something is wrong, email us with your order number and, if you can, a photo. We’ll pay the cost of sending faulty items back to us. For more information about your rights, visit Citizens Advice at citizensadvice.org.uk.

12. Our responsibility to you

If we break these terms, we’re responsible for any loss or damage you suffer that is a foreseeable result of that, or of us not taking reasonable care. Loss or damage is foreseeable if it was obvious it would happen, or if we both knew it might happen when you placed your order. We’re not responsible for loss or damage that isn’t foreseeable.

We don’t exclude or limit our responsibility where it would be against the law to do so. This includes death or personal injury caused by our negligence, fraud, and your legal rights in relation to the products.

We only sell our products for personal use, so we aren’t responsible for any loss of profit, loss of business or business interruption.

13. Your personal information

We only use your personal information as explained in our privacy policy.

14. Complaints

If you’re unhappy with anything, please email us at hello@smouche.co.uk. We aim to reply within 24 hours, Monday to Friday, and to sort things out as quickly as possible.

If we can’t resolve your complaint, we’ll tell you in writing and let you know about any alternative dispute resolution scheme that could help. You can also get free advice from Citizens Advice (citizensadvice.org.uk), and you keep your right to go to court.

15. Other important terms

16. Which laws apply

These terms are governed by the law of England and Wales, and you can bring legal proceedings about our products in the English courts. If you live in Scotland, you can bring them in the Scottish or the English courts. If you live in Northern Ireland, you can bring them in the Northern Irish or the English courts. Wherever you live in the UK, you keep the protection of the consumer laws of the place where you live.

17. Model cancellation form

If you’d like to cancel your order, you can copy this form into an email, fill it in and send it to us. You don’t have to use it: any clear message is fine.
